The Union acts exclusively within the limits of the powers conferred on it in the Treaties,
while the individual member States retain their decision-making autonomy in any other area.
The health system and its organization falls within national competence, according to
Art. 168 TFEU, which provides the European Union with a shared competence only for
certain aspects of public health.
This article aims to analyze the regulatory framework, as well as the actions of the EU insti-
tutions, in the fight against the pandemic emergency, in particular through the analysis of the
initiatives put in place, with regard to the vaccines, by the European Commission and the EMA.
