This paper explores the evolving landscape of affirmative racial gerrymandering in the United States, tracing its trajectory from early Supreme Court jurisprudence to contemporary debates surrounding its legitimacy under the Equal Protection Clause. Drawing upon insights from comparative analysis, the paper first provides a nuanced understanding of the concept within the broader context of electoral districting. It then delves into the historical transition from "negative" to "affirmative" racial gerrymandering, examining pivotal Supreme Court decisions and their implications for fair representation.
