Syllabus

Obiettivi Formativi

a) Knowledge and understanding pertain to both the organizational structure and functioning of national and European institutions, their respective regulatory procedures, the interaction between the two levels of governance and regulation, as well as the main freedoms and fundamental rights.

b) Applying knowledge and understanding: By the end of the course, students will be able to interpret national and European regulations and to coordinate them within a composite legal system, taking into account developments in case law. Furthermore, students will be capable of integrating existing legal rules into the context of ongoing economic, social, and technological transformations.

c) Making judgement: The course aims to equip students with the ability to analyze, synthesize, and critically assess the legal system and its developments, as well as the challenges that the current globalized context poses to the traditional categories of national and European public law.

d) Communication skills: By the end of the course, students will have gained familiarity with national and European technical-legal terminology and syntax. This will enable them to explain, reason about, and relate legal categories to one another, also in reference to the evolving context in which they operate.

e) Learning skills: By the end of the course, students will have developed the ability to carry out a reasoned and critical assessment of the institutional, regulatory, and jurisprudential frameworks underpinning national and European public law.

Prerequisiti


No specific prior knowledge or skills are required other than those necessary for enrollment in the degree program.

Metodi didattici

Lectures aim not only to provide students with the fundamental categories of national and European public law, updated in light of the latest regulatory, jurisprudential, and doctrinal developments, but also to enhance their communication and critical assessment skills. To this end, lectures will be complemented by seminars, guest lectures, and exam preparation exercises. Additionally, students wishing to explore specific topics covered in class will have the opportunity to present the results of their research orally, fostering peer discussions on issues of interest.

Verifica Apprendimento


The exam consists of a pre-test with multiple-choice questions and an oral part for those who pass the pre-test. It aims to assess the student’s knowledge, understanding, use of appropriate legal terminology, and critical evaluation of the topics covered during lectures, as well as the materials included in the adopted textbooks and supplementary resources uploaded to the e-learning platform.
Attending students have the opportunity to present research on topics discussed in class, analyzing their scope and legal implications. A well-prepared presentation may result in bonus points during the examination.

Contenuti

The course will examine institutional organization, competences, and normative sources at both levels, national and European. It will also focus on the implications of the multi-level protection of fundamental rights and freedoms, involving both national and European Courts. Additionally, the course will address some topical and transnational issues in which the European Union has acted as a driver for national legal systems, such as the economic governance framework, environmental protection, and the digital transition.
