The Influence of the CJEU’s opinions on the Italian Courts in the Application of the Unfair Commercial Practices’ Directive

Abstract:
After a short description of the implementation of Dir. 2005/29/UE into the Italian legal system, the essay analyses the interpretation of the main features of the above mentioned Directive in the case law of the Italian administrative indipendent authority in charge of controlling misleading and unfair commercial practices (AGCM). The analysis compares the solutions and arguments adopted by AGCM with the leading cases of the European Court of Justice
